Communication Skills To Deal With Aggressive Patients Nursing Essay This essay will illustrate a personal experience, which demonstrates how practitioners use good communication skills to deal with anger and aggression in patients who are in pain and also recognize and respect choice and religious needs of clients. I was student radiography of about 11 weeks on my first clinical placement. I was working on x ray department which I dealt with and angry and religious patients. . I aim to explore my feelings about the events that transpired, and describe what I would do differently if anything similar situation happens in the future using Graham (1998) framework for reflection. The first centre of discussion shall be in reference to a patient who I will identify as Mr X , to maintain confidentiality Nursing and Midwifery Council 2008) who came for x ray examination for his leg which was in plaster. As a student I attended Mr X with his consent and under the supervision of the mentor. Mr X stormed out of the room in anger after learning that I did not do the procedure right and another x ray was required. That would mean going over the process again yet the patient couldnt bear the pain. The second centre of discussion shall be referred to a nineteen year old Muslim female who was referred from the outpatient department to the x ray department for a head scan due to persistent severe headache. I was doing receptionist duties and I booked her in. She was wearing a religious dress code that covered from head to toe apart from the eyes. As it was against her religion, she refused to take off the cloth covering her head for the scan to be conducted. Before her examination she came back to the reception office to ask if she could get a private room for a prayer.   I gave her directions to a prayer room. Having been into placement for only first time I did not have knowledge to dealt or experience to dealt with angry and aggressive patients who are in pain. I remember that I lost my confidence and I was very upset about myself for failing to handle the situation in a professional manner. As a student radiographers, I should recognise anger and aggression and find out the root cause of it. I am now aware that the best way of dealing with someones anger is to assess and recognise how they are feeling in order to help and diffuse the situation, Walker et al (2004). In light of the above case, I should have apologised for the mistake and use effective communication skills in explanation the the procedure needed for a repeat of the X ray was necessary. The best way to react to clients anger is by listening and acknowledging it. Acknowledgment of anger is very important because the client will definitely calms down. There are proven ways to diffuse tense situations and control anger before it rises to the level of conflict. Empathetic listening is necessary in this case, listen to the patient and truly understand his or her feelings and their needs. It is a way of disagreeing, without being disagreeable. Listen empathetically to the patients distress and apologise without getting defensive. Honest expression means explaining to the patient that you acknowledge his or her frustration in being told to go over the x ray examination process again, but the patient should understand that you a future radiographer and students make mistakes. Students should bear in mind that, any hurtful things said by the client are as a result of his extreme suffering and they need time to work through their anger. Recent study suggests that, older people may use anger as a strategy for maintaining some sense of power over their own lives because as long as they remain angry or resistant, people will notice them. Walker et al (2004), as people get older, they are exposed to a wider variety of situations and are therefore less likely to find new situation stressful, though some older people may be resistant to change. The patient was in severe pain, so i would think he used anger and aggression as a pain coping strategy. Cowan (2000), anger is therapeutic in relieving stress. Hyland and Donaldson (year please) say, health care professional can reduce patient anger by providing the information the patients wants about his condition. So communication plays a very important part in diffusing tense situations. This experience taught me that, anger and aggression could be used as cover for deeper problems. Anger could be a cover up for fear, being used as a shield to keep other people at a distance so they are unable to see ones insecurities and weaknesses, Booth (2003). In real life, older adults are known to express anger outwardly less often and report more inner control of anger using calming strategies as compared to their younger counterparts unless and otherwise. So, looking at the whole incident, the patient was upset to the core by the idea of going over the process again yet the pain was unbearable. I felt that the mr X was trying to express the stress he was going through due to pain. As a student radiography I should try to use my communication skills effectively to take control of the situation by calming Mr X down and be able to understand what he feels by listening to him and asking him questions. Communication is a two way flow of information that nourished client and profes sional relationship that establishes the base of information upon which health planning decision are made and programme developed Spradley and Allender (1996). . Health care professionals need to develop their communication skills of assessing patient. They should be able to form an impression of patients personality and assess the way patient reacts to particular types of situation, Alder et al (2004). To be more effective, as a student radiographers should attempt to understand the extent and expression of the anger, the specific problems resulting from the anger, the function the anger serves and the underlying source of the anger. As a muslim, I am already aware that religious Muslim females from conservative communities will not accept to be examined by a male health care professionals. When miss X arrived for a head scan, I should I have explained to her that there are not a female radiographer in duty to scan her. Unfortunately I did not know she will refuse to be seen by a male radiographer as she was in severe pain. However, I was called to talk to her. I managed to explain to miss X that uncovering her head for medical treatment for a few minutes was not a violation of Muslim religious rules and it was really important for the scan to be done, but she was not convinced. Miss X was a strict practicing young Muslim lady; I never thought she would put religion first before her own health. I told Miss X that I will be her during the examination but she strongly declined. Few minutes after this incident a female radiographer came to collect her payslip and I asked her if she could scan miss X as she refused h er colleague to examine her due to her religion belief. Religion is a very sensitive issue in health care. It plays a very important role in the lives of many religious clients. Putting religious needs first before health needs is unbelievable. This is how important religion is to other people. Many religions carry dress codes or guidelines on appearance and presentation. Overall, dress codes can be a powerful statement of self identity and be a marker of social identity that others will recognise, Giddens (2001). Muslim women are required to cover their bodies as a sign of modesty. Interpretation of the Haddiths differ, so you may see other Muslim women wearing just a head covering whereas others may only show their eyes and they are not allowed to take off their head covering in public or in the presence of men. Henley and Schott (1999) state that some religions provide detailed rules, which may cover aspects of daily life such as prayer, and wearing of religious symbols. Therefore, members of the public and staff should acknowledge diversity and respect the differences within and between groups of people. Health care professionals should understand that each individual is unique and recognise our individual differences, Townsend, cited in Mackay et al (1998). These could be along the dimensions of race, culture, age and religious beliefs. It would be fair to say that, many of the problems faced in the work place around the issue of religion stem from a lack of knowledge and information about other faiths do and believe. However, in health service, patients religion is often noted and disregarded; an important opportunity to find out more about the individual religious and spiritual needs is lost, Henley and Schott (1999). In todays multi cultural Britain, it is important for health care professionals to be aware of and appreciate the difference between Muslims and other religious groups and must demonstrate a non judgmental attitude towards clients. More training is required for members of staff to deliver a service of the highest standard that would not discriminate service users. In an attempt to appreciate diversity, most hospitals have reserved a room for prayers. Most religious patients would do a prayer before being seen for their appointments as they believe that a prayer could aid in recovery, not due to divine influence but due to psychological and physical benefits. Many studies have suggested that a prayer can reduce physical stress, regardless of the God or Gods a person prays to. Of course, other patients pray to seek guidance as the day progresses, and some say it promotes a more positive outlook and strengthen the will to live. In light of this, health care professionals need to demonstrate a willingness to learn about the patients religious beliefs and needs. They should have a deep understanding and a wider knowledge about a range of problems which arise from religious issues. In the provision of holistic care, both male and female radiographers should be always available on duty to meet the religious needs of Muslim clients and other religious groups. Failure to meet the religious needs of patients would be seen as discrimination on the grounds of religion. So, members of staff require appropriate training and a range of skills to successfully work with ethnic minority clients to promote social inclusion.   Ã‚  Ã‚   I believed that a   good communication and open dialogue is the key to diffusing anger and providing culturally sensitive care. I am now prepared for patients who get angry and aggressive. I had always thought before that it would not happen to me and that the person who was verbally attack was to blame in some way. . In the future where patients have an aggressive history, I will be more on my guard. I do feel that I am more aware of the potential of anger and aggression and I have learned to approach situations in a different way from this experience. I have also prompted to read more about anger and aggression in the NHS and learn strategies to dealt with I will take the time to reassure and talk to the patient and ensure that I get their cooperative. Next time when I will be at reception duty, I will try to ask patients if they prefer to be seen by male or female radiographers. A female radiographer should be at least on call rota on duty. If possible, healthcare should be given by people of the same sex as the patient. For female patients, there is an overriding objec tive of modesty and privacy.

Organization Structure The United States Navy is an enormous organization spanning the entire globe. The chain of command covers everyone involved with the Navy from the President of United States all the way down to the eighteen-year old just checking into his first command. There are literally hundreds of different specialized jobs in the Navy all requiring different leadership styles and organization structures. Overall the entire United States Navy is based on a mechanistic organization with some variations throughout do to the wide variety of job fields. For instance my particular job field is one of the more technical fields in the Navy so we generally have some differences in organizational structure than that of the sailor painting the ship painted. I am currently working at the Fleet Area Control and Surveillance Facility (FACSFAC) located at Naval Air Station Jacksonville. FACSFAC as a whole is a mechanistic organization divided into two departments and several divisions providing basic functions ranging from things as complex as air traffic control to maintaining the cleanliness of the building. There is a Department Head over each department with several Division Officers reporting directly to them. The Department Head in turn reports directly to the commanding officer on all matters related to their individual departments. The air traffic control division is further divided into three sections of controllers that report directly to the Radar Branch Chief who reports to the Division Officer. Professionally the sections are managed in a boundary-less, team-based structure although militarily they are still run as a mechanistic organization. In some of the less technical divisions there is only a mechanistic organiz ation. Although the Navy does not have a formal organizational network, its’ use of informal organizational networks are critical to its’ success. Many times during a military career the member will make friendships with other members in the same job field. As time goes on and the members transfer from one facility to another they are able to call on one another for solutions to problems they may come across. With the rise of the Internet these networks are being used in situations that in the past would have been impossible. There are basically four major types of boundaries affecting businesses today, the authority boundary, task boundary, political boundary and the identity boundary.

Defects of Consent Essay

A defect of consent is a situation where a party’s declaration does not reflect his actual intent. This difference between declaration and intent may be caused by other parties,in order to make someone to form a contract with themselves. Fraud and Duress are this kind of defects. Roughly,fraud is deceiving someone by hiding certain facts or giving them a wrong impression/information in order to make them form a contract and duress is scaring or threatening someone to make them form a contract. If there is a difference between declaration and intent,which unintentionally resulted from the declarant,we can say there is an error. In some cases,both parties are mistaken about contract. Such defects are called â€Å"Collective Error†. In these situations,contract is formed by parties’ true intent,not according to their false statements. Error In the TCO article 30,the law states that â€Å"A party acting under an essential error when entering into a contract is not bound by it. † Interpreting this article,we can deduce that essentiality is a key concept,since unessential errors will not affect validity of the contract. Some aspects of essential error are specified in TCO,but law does not limit cases of essential error with those articles. Unwritten states of essential error are determined by the rules of good faith. Error may occur in several ways: Error in declaration In the TCO article 31 the law sets forth: An error is deemed particularly essential in the following cases 1-Where a party intended to conclude a contract different from that to which he consented. A wants to sell 100 kilos of olive oil to B,but during the formation of the contract, A inadvertently states that he wants to buy 100 kilos of olive oil and B agrees the offer. -Where a party has concluded a contract relating to a subject matter other than the subject matter he intended. A wants to buy E branded good,but during the formation of the contract he states he wants to buy F branded good by mistake and is not aware of it. 3-Where a party declared his intent to conclude the contract other than the whom he intended to. A wants to send an offer via mail to B,but he writes a different adress and mail goes to C. C accepts the offer. 4-Where a party took a specific person into consideration as the other party in entering a contract but declared his intent to another. A is a nanny who wants to raise B’s child C,but during the formation of the contract she stated the name of B’s mentally deficient child D. A is mistaken about someone’s identity,not someone’s qualifications. Otherwise it would be error in motive,which shouldn’t be confused. 5- Where a party has promised to make a significantly greater performance or has accepted a promise of a significantly lesser consideration than he actually intended. Error in calculation of a simple nature do not affect the validity of the contract;but they should be corrected. A good should have 10. 000 dollars written on its label but accidently 1000 dollars is writtenon label. A buys the good for 1000 dollars. Error of Agents The law states in TCO article 33 that â€Å"Where an offer to enter into a contract has been incorrectly communicated by a Messenger,translator or other agents or by any means,the provisions governing error are applicable†. Error of agents are counted as error in declaration. Mistranslation,misinforming,changes in the text during telegraphing†¦ are examples of such errors. Error by Considering a Demeanour as Consent When a party’s action is considered as an offer or acceptance by another party,and the other party is right to consider this as such and forms the contract,contract will be valid. However mistaken party can put forward that he is mistaken and benefit from the provision of error in declaration. Texts signed without reading If a party signs a text without reading ,and is right to think that the text suits his intent,outcome is determined by the other party’s knowledge about this intent. If the other party knows or has to know that text does not suit signer’s intent,contract will not have been formed and thus there will not be any need for provisions of error. On the other hand,if the other party does not know or have to know the signer’s intent,contract will be formed,but signing party by proving that the error is essential,can benefit from provisions of error in declaration. Signature in Blank One of the parties agree to sign in blank first,then allow other party to constitute the contract. If this contract formed later on has contents which do not suit signing party’s actual intent,he can benefit from provisions of error. Error in Motive Error in motive is caused by an error in the formation of intent. On principle,error in motive is not essential. If there are conditions prescribed by the law,there is an essential error in motive. In TCO article 32,the law sets forth that â€Å"Error in motive is not deemed as essential unless the mistaken party deems the motive as necessary basis for the contract and it is valid regarding the business affairs in good faith. Yet this rule is not applicable unless the other party is aware of this motive† According to this article,error in motive is essential if the party deems this motive as necessary basis for the contact. This means the party is mistaken about a subject or qualifications of someone which affected his decision to form the contract. Error in material qualification,error in fact,error in legal status are examples of such mistakes. A wants to buy sculpor B’s statue but in fact the statue is a replica. In this situation there is error in material qualification. A thinks he is assigned to a job in another city,so he rents a house in that city. He made an error in fact. A purchases a land to build a house,but does not know construction is forbidden on this site. He is mistaken about land’s legal status. Also if other party is or has to be aware of the motive,error is deemed as essential. This should be determined in the present case. Avoidability In TCO art. 30 the law stipulates that â€Å"A party acting under an essential error when entering into a contract is not bound by it. † However this is limited by TCO art. 39. The contract will be valid if the mistaken party does not abolish the contract in a year,beginning from the moment he realises his error. Good Faith Rules in Error Right to avoid is also limited by the law. The law states in TCO art. 34 that â€Å"A person may not advance error in a manner in violation of good faith. In particular, the contract is considered to be concluded in a way that the party acting in error intended, in case the other party declares his consent to be bound by that contract. † Violation of good faith mentioned in the first subsection may be like this: A person learns that he made an essential error about a contract which he concluded years ago. He wants to use his right to avoid just to damage other party. In that case he will not be able to benefit from provisions of error since it is a violation of good faith. Second subsection of this provision is particularly important. I wish to give a case in this point,in order to better explain it: A wants to buy a kilo of fruit for 2 Liras,but he is mistaken and accepts B’s offer to buy a kilo for 3 Liras. Then A states his mistake to B,B immediately says he is ready to sell it for 2 Liras. In this situation A cannot put forward that he wants to nullify the contract,since he made an essential error. The contract is formed. Error by Negligence According to TCO art. 35 â€Å"A party acting in error is liable for any loss arising from the nullity of the agreement where the error is attributable to his own negligence. However, there is no compensation if the other party knew or should have known of the error. In the interests of equity, the Court may, not exceeding the benefit of standart performance, award further damages to the injured party. † The first subsection is about responsibility of parties’ actions before the formation of the contract (culpa in contrahendo). Even a slightest negligence in error results in culpa in contrahendo,and in such situations damages will be compensated. According to the second sentence of this subsection,there will not be any compensations if the other party knew or should have known of the error. But this provision is not applicable to error of declaration,since if the other party knew or should have known the error in declaration,contract is formed according to the declarant’s real intent. Yet if a party knows or has to know other party made an error in motive,mistaken party will not have to compensate any damages even if he abolishes the contract. Amount of the damage that will be compensated,is the damage that would not exist if the contract would not be formed. This kind of damage is â€Å"negative damage†. Benefit of the standart performance is named as â€Å"positive damage†. According to the second subsection,judge may decide further damages. This â€Å"further damage† is compensation of positive damage. Amount of positive damage that must be compensated may be some of the positive damage or all of the positive damage,determined by equity,but cannot exceed positive damage.
